    No Criminal Charges: Relief For US Cop Who Killed Indian Student

A U.S. prosecutor has asserted a lack of “sufficient evidence” to pursue criminal charges against the responsible police officer, Kevin Dave. The prosecutor, King County Prosecuting Attorney Leesa Manion, acknowledged the global and local impact of the incident but maintained that the evidence did not warrant criminal charges against Officer Dave.

    Despite the acknowledgment of the severity of the situation. Bodycam footage released by the Seattle Police revealed disturbing behavior from another officer. Daniel Auderer, who was not directly involved in the collision but was present at the scene. In the footage, Auderer callously laughed about the deadly crash. Dismissed the need for a criminal investigation and made insensitive comments about Ms. Kandula’s age and value.

    Prosecutor’s Decision

    Prosecutor Leesa Manion expressed deep concern over Auderer’s comments, labeling them as “appalling and deeply troubling.” However, she clarified that, as egregious as Auderer’s remarks were, they do not alter the legal analysis of Officer Dave’s conduct. Instead, the inappropriate behavior of Officer Auderer falls within the jurisdiction of the Office of Police Accountability (OPA). Which is tasked with addressing and investigating such unprofessional conduct within the police force.

    Despite the disturbing nature of the incident and Auderer’s behavior, Officer Dave, the driver involved in the collision, is currently not facing criminal charges, leaving questions about accountability and justice unanswered, at least for the time being. The video featuring Auderer callously discussing Jaahnavi Kandula’s death has not only intensified public outrage. But has also raised concerns about the prevailing culture within the Seattle Police Department.In the video, Auderer made insensitive remarks, stating, “She was 26 anyway. She had limited value.” These comments have contributed to the growing scrutiny of the police culture in Seattle.

    Local media in Seattle reported that excessive speed was the primary factor leading to the collision. As Officer Kevin Dave’s high-speed response did not afford Ms. Kandula enough time to perceive, address, and avoid the imminent danger. The officer did not consistently activate his siren, choosing to “chirp” it at the intersection. While emergency lights were in use, the absence of a continuous siren, coupled with the high speed, has prompted questions regarding the urgency and necessity of such a rapid response.
