On Tuesday, the executive committee of the Supreme Court Bar Association disassociated itself from a letter written by SCBA chief Adish C Aggarwala, which requested a presidential reference regarding the apex court’s verdict on the electoral bonds scheme case. The bar association also criticized the letter’s content, describing it as an effort to exceed boundaries and diminish the authority of the Supreme Court.

Adish C Aggarwala Urges Presidential Reference on Electoral Bonds Verdict
Adish C Aggarwala, who serves as the chairperson of the All India Bar Association, penned a letter to President Droupadi Murmu, urging her to request a presidential reference regarding the verdict in the electoral bonds scheme case. He also advised against implementing the verdict until the matter is reheard by the top court. Aggarwala stated in his letter to the President that disclosing the names of corporations that contributed to various political parties would make them susceptible to victimization.

Aggarwala’s Concerns Regarding Disclosure
Aggarwala expressed concern that revealing the names and contribution amounts of corporations to political parties could lead to potential targeting and harassment by parties that received less funding. He emphasized that such disclosure would breach the promise made to these corporations when they made voluntary contributions. Additionally, Aggarwala warned that disclosing such sensitive information, especially retroactively, would discourage corporate donations and their involvement in the democratic process. Although Aggarwala’s position as President of the SCBA was list below his signature, the letter was issue on the letterhead of the All India Bar Association.
SCBA Executive Committee Disavows President’s Letter
Executive Committee of the Supreme Court Bar Association finds it necessary to emphasize that its members neither authorized the President to write such a letter nor do they support the expressed views. The resolution, signed by SCBA secretary Rohit Pandey, states that the Executive Committee considers this action and its contents as an effort to exceed boundaries and diminish the authority of the Honorable Supreme Court of India, and unequivocally denounces it.
