Acharya Balkrishna, the managing director of Patanjali Ayurved Limited, issued an unequivocal apology for his company’s deceptive assertions regarding the extraordinary powers of its products, which also undermined the efficacy of modern medicine. One day after the highest court summoned him to appear in person along with Baba Ramdev on April 2nd, Acharya Balkrishna submitted his apology in a sworn statement.

Violation of Law and Court Order:
The company’s assertions regarding the ability to cure various illnesses including blood pressure, diabetes, asthma, and other ailments not only breach the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954 but also constitute contempt of court. This is because, on November 21, 2023, the highest court restrained Patanjali from disseminating such advertisements and documented a commitment made by the company in this regard.

Unconditional Apology and Pledge for Future Compliance:
“The affiant expresses regret that the advertisement, intended to convey only general statements, unintentionally contained the offending sentences… On behalf of the respondent (Patanjali Ayurved), the affiant presents an unconditional apology to this Court for the violation of the statement outlined in the order dated November 21, 2023. The affiant pledges to prevent the issuance of such advertisements in the future.”

Affidavit Defense and Assertion of Scientific Data:
He also asserted that the department responsible for the advertisement was unaware of the court order. However, his affidavit appeared to defend the company’s position. Referring to the 1954 law as “outdated,” he stated: “Patanjali now has scientific evidence-based data from clinical research conducted in Ayurveda, which would illustrate the progress made through scientific research in relation to diseases listed in the Schedule to the 1954 Act.” This schedule enumerates diseases for which advertisements claiming a cure are prohibited.
