A Gujarati guy from Banaskantha petitioned the High Court to grant custody of his fiancée, who was already wed to another man. Infuriated by the petition, the Gujarat High Court fined the petitioner Rs 5,000 and declared that he lacks locus standi.
On the basis of their living together agreement, the guy asked her husband for custody of his girlfriend. According to reports, the petitioner was dating the woman he said was married against her choice.
The woman left her husband and marital home to live with the man, after which they stayed together and also signed a live-in relationship agreement.
The High Court bench comprising justices VM Pancholi and HM Prachak noted that the woman had not divorced her husband and thus custody could not be given on the basis of a live-in relationship agreement.
